So recently my girlfriend has been receiving calls from "Luebke Baker and Associates" a supposed debt collection agency trying to milk hundreds of dollars (Oh! but if we pay now they'll reduce the debt!) out of her for magazines she never ordered nor received. Thanks to some detectiving I found a lot about the company, and the people they were supposedly collecting for. During the calls they violated many aspects of the FDCPA, including but not limited to:
Calling frequently (she got over 10 calls today alone, and more yesterday) Abusive language Threats (While the creditor is legally allowed to pursue legal action, debt collectors are not) Each time we've tried to get more information and demanded to see some sort of evidence, or at least a letter or bill so we can dispute it in court, but they said they couldn't send anything until she agreed to pay them. Then, when we try to get any information about the company they promptly hang up, only to call back some minutes later. Looking through the almighty google I have found hordes of people who have been hit by the same people, sometimes receiving calls for years! They are collecting for "Consolidated Media Services", a company that got its ass handed to itself years ago for bad business practices. There is a bright side though: lots of people have sued for fraudulent debts, and from the court cases I've accessed, all have won. Currently we're planning to contact the Illinois Attorney General (LBA is based in Illinois) and possibly even look into finding a lawyer. There's gotta be at least one competent lawyer out there who will work for some settlement money. We ain't rich, but if a lawyer will work solely for a percent of the potential winnings, that sounds like a good idea. So that's the plan. Any other ideas?
